Frequently Asked Questions

Documents vary by matter. Commonly useful items are a government ID, any notice, summons, FIR or court order received, relevant agreements or correspondence, and a short written timeline of events. Bring whatever you have; your advocate will tell you what else is needed.

Anticipatory bail is a direction that a person be released on bail if arrested, sought when they fear arrest in a non-bailable offence. It is applied for before a Sessions Court or High Court, which may impose conditions. Whether it is granted depends on the facts of the case.

In general, a legal notice may be sent first, followed by filing a plaint, service of summons, the defendant’s written statement, framing of issues, evidence, arguments and judgment. Mediation or settlement may be explored at several stages. Duration varies widely with the court and the case.

Fees usually depend on the nature and complexity of the matter, the court or forum, the stage of proceedings, the research and drafting involved, and the advocate’s experience. Fees should be discussed and agreed with your advocate at the outset.

The right forum depends on the type of dispute, its value, where the parties live or where the cause of action arose, and the governing statute. Some matters go to tribunals or consumer commissions rather than civil courts. An initial consultation can help identify the correct forum.
